Online gambling is legal in the United States and many states have laws to regulate it. However, there are a number of issues with online gambling. First, the morality of gambling is a major issue. Nevertheless, most gambling sites strive to offer fair games and provide options for players to self-exclude if they become addicted or experience gambling problems. While the Wire Act of 1961 largely regulates the industry, it doesn’t prohibit online gambling altogether. In fact, some countries have legalized online gambling, including many states and provinces in Canada. In the United States, some forms of online gambling are regulated by state governments, including lottery games, sports betting, and horse races.
While gambling is largely a matter of state law, federal law is sometimes invoked in criminal cases involving online gambling. Federal laws usually reinforce state laws but interstate or foreign elements can frustrate state enforcement efforts. In fact, some state officials are worried that the internet will be used to bring illegal gambling into their states.
Further, enforcement of federal gambling laws has been challenged on constitutional grounds. However, attacks based on the Commerce Clause, the First Amendment’s guarantee of free speech, and the Due Process Clause have all had limited success. Commerce Clause doubts have been addressed by the commercial nature of gambling, while free speech objections have been largely sidelined by the First Amendment’s limitations on criminalizing speech.
