The Wire Act prohibits the unlawful gambling of sporting events. In addition, the law prohibits the use of facilities for illegal gambling on interstate commerce.
UIGEA is an attempt to curb the proliferation of illegal gambling on the Internet. It requires that Internet gambling operators be licensed by the director of the Financial Crimes Enforcement Network. Also, it requires that internet gambling operators establish security standards for data and location verification.
UIGEA also imposes penalties on individuals who are found guilty of violating the act. These include both fines and imprisonment. For example, a breach of the guidelines can result in a fine of up to six months.
Several other federal criminal statutes are involved in the case of illegal internet gambling. They include the Racketeer Influenced and Corrupt Organizations (RICO) provisions, the Wire Act, and the Illegal Gambling Business Act.
Some state officials have expressed concerns that the Internet could be used to bring illegal gambling into their jurisdictions. But other state law does not explicitly address the question of whether the Internet can be used to carry out illegal gambling.
